1. Acknowledgment of Risk - I, the purchaser, acknowledge that I have voluntarily chosen to use the product named above. I understand that use of this product may involve certain risks, including but not limited to personal injury, property damage, or other harm.
2. Assumption of Risk - I accept and assume all risks associated with the use, handling, or operation of the product. I acknowledge that I am solely responsible for any injury or damage that may occur as a result of using this product.
3. Release and Waiver - To the fullest extent permitted by law, I hereby release, waive, discharge, and covenant not to sue the manufacturer, company, its agents, employees, officers, or affiliates (collectively, the "Released Parties") from any and all liability, claims, demands, causes of action, or damages arising out of or related to any loss, damage, injury, or death that may be sustained by me or my property as a result of using this product.
4. Indemnification - I agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or costs, including court costs and attorney fees, that may incur due to my use of the product or my violation of this agreement.
5. No Warranty - I understand that the product is provided "as is" without any warranties, either express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.
6. Governing Law - This waiver and release shall be governed by and construed in accordance with the laws of the province of Manitoba, without regard to its conflict of law principles.
7. Severability - If any provision of this agreement is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
8. Agreement by Purchase - By purchasing this product, I acknowledge that I have read, understood, and agree to be bound by all the Terms and Conditions and the terms set forth in this Product Liability Waiver and Release Form.
